This post was written and originally published by the RMI. On 22 June 2022, Doctor M. J. Phaala, Minister of Health, terminated certain sections of the National Health Act, which were in effect to combat the spread of COVID-19 in our communities. Since the repeal of these sections of the Act, we received several queries from members uncertain about which measures still apply in the workplace. To clarify uncertainty, take note of the following: It is not compulsory to wear a face mask in an indoor public space. The restrictions on both indoor and outdoor gatherings are repealed. The provisions concerning international travel into South Africa are no longer in effect. This does not mean that all regulations regarding the management of COVID-19 in the workplace are repealed. The Hazardous Biological Agents Regulations and the measures for COVID-19 in the workplace regulated by the Code of Good Practice are critical and are still in force and effect. Therefore, risk assessments need to be kept updated and The Hazardous Biological Agents Regulations and the Code of Good Practice, as communicated earlier, still dictates the response of the business regarding, ventilation, sanitizing, and so forth. The Unemployment Insurance Fund (UIF) have announced that if your business was one of the many that applied for and benefitted from COVID-19 relief this year through The Temporary Employer-Employee Relief Scheme (TERS), your business will be audited. Business Tech reported on 30th November that companies that received money through TERS will be audited by forensic auditors. What Will Be Checked? Checks for the following (but not limited to) will be done; financial recordsauthenticity of claims proof of payment to workers. Who Will Be Completing the Checks? Jakkie Olivier, Chief Executive Officer of the Retail Motor Industry Organisation (RMI), representing almost 8 000 businesses in the automotive aftermarket sector, believes that with so much pressure on the commercial sector right now to remain financially viable and to preserve jobs, it is time attention started to be focused on the regulatory factors which employers are struggling with. The Cost of Compliance? Olivier says late last year RMI commissioned IQ Business, the largest independent management consulting firm in South Africa, to conduct research into the Cost of Compliance and its impact on commercial sustainability in the retail motor industry. The report found that the 3 rd biggest risk for businesses in 2020 was in fact changes in legislation and regulation. The South African Government has extended the COVID-19 Temporary Employee Relief Scheme (TERS) benefits to 15 August 2020. Following fraudulent activity surrounding UIF payments, increased bank verification controls have been put in place. Dear valued member HOW TO DEAL WITH TAX OF TERS BENEFITS We have received numerous queries with regards to the tax implications of TERS benefits and are aware of the uncertainty relating thereto. We hope this short newsflash will provide the necessary clarity. It is important to note that the employee is the beneficiary of a TERS claim. The employer merely administers the claims process and payment on behalf of the Unemployment Insurance Fund (UIF). A TERS payment from the employer to the employee does not, therefore, constitute remuneration and is subsequently exempt from income tax. Employers should not reflect TERS payments on payslips or withhold any monies for pay-as-you-earn (PAYE). Employers should also not include TERS payments for PAYE reporting purposes to SARS. TERS payments should similarly not be taken into account when calculating other benefits such as Provident Fund contributions. In summary please ensure you communicate TERS payments separately to employees and do not include these on employee payslips.

We are writing to you on the eve of the 21 days lockdown, announced by President Cyril Ramaphoza on the 23rd of March 2020, in the hope that we will be able to address questions and concerns that may have surfaced over the last few days. Yesterday, the Minister of Cooperative Governance and Traditional Affairs, Minister Nkosazana Dlamini-Zuma, published further regulations that will apply during this period of lockdown. The South African Motor Body Repairers’ Association (SAMBRA) has put in an urgent appeal to the insurance sector, through SAIA, to consider alternate payment and fee arrangements for at least the next 30 days. It is critical for the sustainability of the sector that our members are paid immediately on submission of invoice and that the insurers consider foregoing all settlement discounts for at least the next 30 days. We are critically aware of the crisis that faces the country and the impending damage to small business appears inevitable. If SAIA can encourage the insurance industry to pay MBR members immediately, irrespective of current SLA conditions, and do away with all invoice discount deductions, we will be in a much stronger position to ensure the sustainability of our members who are all predominantly small to medium-sized businesses. We would also like to reassure our members that through RMI, we are also investigating all the various interventions which are being made available by Government and industry to lessen the financial burden on business and help cushion business from these economic difficulties. Following President Cyril Ramaphosa’s announcement last night for a national 21- day lockdown, the Retail Motor Industry Organisation (RMI), are ramping up their appeal to Business Unity South Africa (BUSA) to convince Government to declare tyre-, parts- and accessory retailers, as well as repair- and maintenance servicing outlets for motor vehicles and motorcycles, “essential services” and not to limit their functioning as part of any business closures within South Africa due to the Covid-19 Pandemic. Jakkie Olivier, Chief Executive Officer of the Retail Motor Industry Organisation (RMI), says that he believes the RMI, representing almost 8 000 businesses in the automotive aftermarket sector, can play a key role in the task teams that have been set up by BUSA in conjunction with Government to proactively assess and implement business initiatives to deal with the impact of Covid-19 in health, the labour market and the broader economy.
