VTA supports call for stricter roadworthy testing measures
The Vehicle Testing Association (VTA), a proud association of the Retail Motor Industry Organisation (RMI), strongly supports the need for stricter oversight and enforcement in the country’s roadworthy certification process. This follows a recent investigation by the Organisation Undoing Tax Abuse (OUTA), which uncovered widespread corruption at vehicle testing stations (VTSs), where fraudulent roadworthy certificates were issued without physical inspections. VTA Urges Stricter Oversight and Testing Standards VTA Chairperson, Ferose Oaten, acknowledges the validity of OUTA’s findings and confirms that similar issues have been observed in the Western Cape. “We have experienced instances where a vehicle is placed on the inspection pit, only for the driver to receive a call from the owner instructing them to stop the test because they have already obtained a certificate from another province.” Oaten stresses the importance of addressing this issue urgently. “Fraudulent certifications endanger lives and must be eradicated to ensure that only roadworthy vehicles are on our roads. We would like to address a critical matter regarding delays in processing invoice payments by Santam, specifically attributed to integration issues within the Audatex system, impacting the AudaInvoice system. Automatrix OEM Application/Approval Process
The following updated was issued by Automatrix and shared with SAMBRA Members. This letter serves to confirm the processes followed by Automatrix, and the various OEMs it is contracted to, in respect of applications for approval, as further set out hereunder: All applications for approval must be submitted via the Automatrix Applications portal. No manualsubmissions are accepted. The process includes the following 5 steps:a) full details of all terms and conditions, approval criteria, any additional requirements, costs etc.b) copy of the OEM Service Level Agreementc) self-audit process, including summary of rectification required, if applicabled) supporting document uploade) applications log with progress tracking Only those applications that complete each respective step, and pass the self-evaluation section can be submitted to OEMs via the Automatrix portal. Successful applications, together with copies of items 1-4 above, are automatically captured on to an applications log, and can be accessed by both OEMs and body shops in order to track progress, timelines, OEM queries etc. The above processes are completely automated, and do not require human intervention. This aims to ensure that any possible subjectivity or bias is eliminated from the process, and offers completetransparency throughout. Newsflash: Warning to Motor Body Repairers
Please be mindful that theft is increasing, and criminals are using various tactics to acquire their desired items. Toyota Menlyn issued a warning to all Motor Body Repairers, Roadworthy Stations, and Car Washes to be extra vigilant, as they have fallen victim to theft. Criminals contacted the suppliers, posing as representatives of the dealership. They have accurate information about the vehicles, leading the suppliers to release the vehicles to the criminals. Unfortunately, the criminals successfully drove off with two Toyota Quantum’s. Please ensure that all staff members are made aware of this incident and the security threat it poses. Instruct them to confirm and verify the identity of anyone coming to collect a vehicle. It is essential to make a photocopy of the ID or driver’s license of the person collecting the vehicle and use this information to cross-verify with the client, ensuring that the correct individual is indeed collecting the vehicle. This additional layer of identification verification can contribute to preventing unauthorised persons from taking possession of vehicles. View Newsflash

RMI Newsflash: Free State Protest Action
The RMI received reports of communication being circulated advising of a ‘national shutdown’ in certain parts of the Free State on 1 July 2023. The purpose of the shutdown is to address substance abuse, corruption, human trafficking, counterfeit products and loss of jobs for citizens, the removal of illegal immigrants, non-compliant foreign businesses and the increase in job skills, jobs and businesses. The affected areas are Thaba Nchu, Bloemfontein (Mangaung), Soutpan and Botshabelo in the Free State. According to the RMI’s sources, the planned protest action has not been approved by NEDLAC in terms of section 77 of the Labour Relations Act and is therefore deemed to be unprotected. The RMI will inform members of any developments in this regard. ABSA has scooped top honours and for the first time won the prestigious SA Motor Body Repairers’ Association (SAMBRA), Insurer of the Year award, followed closely with a silver award to both Bryte Insurance and OUTsurance in joint second place. Volkswagen Group South Africa received joint top honours for all-round best OEM followed by Ford Motor Company SA and in third place BMW MINI South Africa. Glasurit triumphed as best Paint Brand followed by Duxone and R-M. The award ceremony, which this year was once again jointly hosted by SAMBRA and Lightstone, took place in Johannesburg on 23 March at Radisson Blu Sandton honouring top vehicle insurers and OEMs, as well as automotive Refinishing brands, for excellence in service provision to SAMBRA members. Newsflash: Notice of new Service Level Agreement from Momentum
Please be advised that Momentum will be mailing a new service level agreement [SLA] next week to all SAMBRA members for their consideration. The process is quite a manual-intensive exercise so they expect the exercise to continue until the end of April 2023. We have been advised that all discussions and negotiations will be done with the individual member and not at the association level, as per their governance requirements. This means that you may not all receive the SLA on the same day or week. The SLA is made up of three parts, including the main agreement, operational requirements, and rates & fees. The SLA template will be the same for all recipients. You must not sign the emailed document. Only once there is mutual agreement on the terms, an electronic version will be sent out for your signature via DocuSign. The person authorised to sign the SLA will receive a One-Time-Pin on their cell phone, allowing them to access and sign the document. Kindly be informed that our offices have received notice advising that SAFTU will proceed with protest action commencing on the 20th day of March 2023 at 00h05am and ending on the 21st day of March 2023 at 07h00am. All provinces across the country and all major cities may experience protest action in support of SAFTU’s concerns over the socio-economic challenges affecting workers and the working class in general. All procedural requirements have been met therefore the protest action has been approved by NEDLAC, and as such, is regarded as being protected in terms of the Labour Relations Act. Accordingly, employees who decide to participate in the protest will be protected by the statutory rules regarding protected strike action, and consequently may not be disciplined for participating. Members are reminded that the ‘no-work-no-pay’ principle shall apply during this period. Furthermore, this principle will apply in instances where members receive notification from their employees informing them that they are unable to report for duty on the day due to the unrest or due to them receiving threats or being intimidated. RMI Newsflash: Wage Negotiations update July 2022
On 12 July 2022, the parties to the Motor Industry Bargaining Council (MIBCO) had a council dispute meeting, after NUMSA declared a formal dispute earlier in July. Despite the RMI’s request that the dispute should be resolved through bilateral engagements between the parties as earlier suggested by NUMSA, they elected that the matter be referred for mediation, which is now set for 2 and 3 August 2022. Further engagement steps will naturally follow once the mediation process commences and we will as always keep our members informed as the matter progresses. Are you wondering what business activity will be permitted from 1st May? Can panel beaters and motor body repairers’ reopen? Read the below Newsflash published by Richard Green, SAMBRA National Director, for some assistance on the matter. Dear SAMBRA Member The government recently announced that our country will move to Level 4 on the 1st of May. Various reference documents have been circulated, the two most applicable in my mind are attached, to guide us on what is permitted in terms of business activity. This is a question which is top of mind for each and every SAMBRA member. Document 1 -titled “Permitted Goods and Services” quite clearly allows, under level 4 clause L3, “Emergency repairs for all persons”. View Document Document 2 is a simple user-friendly indicator detailing which business categories are allowed to operate at a reduced level and those that are still in Lockdown. How To Deal With Tax of TERS Benefits
Dear valued member HOW TO DEAL WITH TAX OF TERS BENEFITS We have received numerous queries with regards to the tax implications of TERS benefits and are aware of the uncertainty relating thereto. We hope this short newsflash will provide the necessary clarity. It is important to note that the employee is the beneficiary of a TERS claim. The employer merely administers the claims process and payment on behalf of the Unemployment Insurance Fund (UIF). A TERS payment from the employer to the employee does not, therefore, constitute remuneration and is subsequently exempt from income tax. Employers should not reflect TERS payments on payslips or withhold any monies for pay-as-you-earn (PAYE). Employers should also not include TERS payments for PAYE reporting purposes to SARS. TERS payments should similarly not be taken into account when calculating other benefits such as Provident Fund contributions. In summary please ensure you communicate TERS payments separately to employees and do not include these on employee payslips.

SAMBRA Appeals to SAIA: Close Payment Gaps
The South African Motor Body Repairers’ Association (SAMBRA) has put in an urgent appeal to the insurance sector, through SAIA, to consider alternate payment and fee arrangements for at least the next 30 days. It is critical for the sustainability of the sector that our members are paid immediately on submission of invoice and that the insurers consider foregoing all settlement discounts for at least the next 30 days. We are critically aware of the crisis that faces the country and the impending damage to small business appears inevitable. If SAIA can encourage the insurance industry to pay MBR members immediately, irrespective of current SLA conditions, and do away with all invoice discount deductions, we will be in a much stronger position to ensure the sustainability of our members who are all predominantly small to medium-sized businesses. We would also like to reassure our members that through RMI, we are also investigating all the various interventions which are being made available by Government and industry to lessen the financial burden on business and help cushion business from these economic difficulties. Once you have finalised the administration submit your invoice and request immediate payment from Insurers with whom you have an SLA. Any Insurer that you do not have an SLA with we recommend that you exercise your right of lien and receive payment prior to releasing the vehicle. Please communicate with all clients who have vehicles in the repair process and ensure that you provide them with the most accurate estimate of delivery time or if the vehicle will need to stand over for any reason whatsoever – in all cases please ensure the Insurer concerned is notified.
